Your registration with and/or use of this website is subject to these terms and conditions.
The iProfile website is owned and operated by SkillsMarket Ltd (a company incorporated
in accordance with the laws of England and Wales). The following terms and conditions
shall govern the use of iProfile via this website and the services provided in Australia
by SkillsMarket Pty Limited ACN 131 606 418 (a wholly owned subsidiary of SkillsMarket Ltd)
and its related entities (together referred to as “we”, “us”, “our” and “SkillsMarket”) and
are binding upon you.
These terms and conditions may be revised from time to time, as published on this website.
You should review these terms and conditions regularly to ensure you are familiar with any changes.
SkillsMarket reserves the right to modify these terms and conditions and your continued use of the
iProfile website after such changes have appeared on this website shall be deemed to be acceptance
of all such changes to these terms and conditions.

iProfile account holder; and

iProfile Compatible Organisations and other third parties.
1. TERMS OF USE - iPROFILE ACCOUNT
The following terms and conditions apply to the registration of an iProfile account and the
creation and use of your iProfile via this website and the services provided by SkillsMarket
and are binding upon you.
What we do for you
When you register with us, we will use your information to create your iProfile account with
access to your own iProfile. Your iProfile will set out your personal information, skills,
experiences and job expectations in a highly structured format on the iProfile database. You
may update or amend your iProfile at any time.
“Your information” which is contained in your iProfile, includes any data or information
that you provide to us or to an iProfile Compatible Organisation via this website, written
documents, email, telephone, fax, face-to-face (or any other form of communication) and
includes your name, contact details, curriculum vitae or resume, career information,
experience and abilities and academic results.
Your information may be made available to other iProfile Compatible Organisations as a result
of your use of those other organisations' services and to those third parties that you grant access
to your iProfile.

Our responsibilities
SkillsMarket and its partners endeavour to maintain and develop a detailed structure that enables you
to build a comprehensive iProfile of your skills and competencies. You may download and use your iProfile
for the purpose of developing your career. We will notify you if we alter any of your information in your
iProfile. Should you wish to remove your information from our files you can do so by clicking on the
link at the end of these terms and conditions.
Your responsibilities
You are responsible for ensuring that your information is accurate and up to date and that the iProfile you
maintain accurately reflects your skills and competencies and is not misleading.
You shall not use this or any other iProfile service to distribute defamatory, obscene or hateful material,
nor shall you attempt to violate the security of the website. You shall ensure that you have received any
appropriate permission when disclosing information confidential to other persons. You shall not disclose
your password to any third party and you are responsible for any actions undertaken by you or third parties
that are identified with your password.
Our rights
We have the right to remove your iProfile and your information from the database and accept or reject at our
sole discretion any person wishing to register an iProfile account. We may, in certain circumstances, alter
your information in your iProfile but we will notify you if we do so.
SkillsMarket and its partners may use your information for the purpose of managing and administering your
iProfile via this website and for the purpose of providing our services, within the limits of confidentiality
placed upon us by you, the privacy (data protection) legislation applicable at the time, and in accordance
with these terms of use (see "Privacy Policy" below for more information on the use of
your personal information).
By creating, or agreeing to the creation of, your iProfile, you grant us a non-exclusive, perpetual,
worldwide licence to use, copy, modify and adapt your information (including any intellectual property in
any documents provided) for the purposes of providing our services (and all things incidental to performing
those services). You also grant us the right to sublicense this right to others for the purposes of enabling
them to provide their services, including the right to grant sublicenses to iProfile Compatible Organisations
and to overseas data processing organisations.
All trademarks, copyright, patents and other intellectual property rights which may exist in the iProfile
system are the property of SkillsMarket and its partners and may not be reproduced, or used without the
express written permission of SkillsMarket.
Your rights
You may access, remove, update or amend your information contained in your iProfile at any time. You may
download and use your iProfile at any time. You can control access to your iProfile by clicking on the
link at the end of these terms and conditions.

Our liability
We do not guarantee that you will find work through the use of this service. Nor do we ensure the nature,
validity or conditions of any vacancy and we are not responsible for the use of your information by any
third parties, including recruiters and employers. SkillsMarket and its partners do not guarantee the
availability of the iProfile system and cannot be held liable for corruption of your information on the
system or for loss resulting from any inaccurate or misleading information inputted into your iProfile or
your use otherwise of the system. SkillsMarket does not warrant any of the information or services provided
by it or any partners. Neither SkillsMarket nor its partners warrant the completeness, accuracy or reliability
of the system and they are not liable for any loss resulting from use of the system.
Your liability
You agree to indemnify and hold harmless SkillsMarket and its partners from any liabilities, claims or
demands resulting from your use of this system. SkillsMarket and its partners do not warrant any information
provided as a result of these services and you should seek professional advice before placing any reliance
on the information.
General
SkillsMarket is committed to equality of opportunity and to non-discrimination on the grounds of colour,

You acknowledge and consent to certain information you provide being combined and aggregated with other
candidates' information for the purpose of providing industry intelligence without revealing any
personally identifiable details.
The laws of NSW, Australia shall govern this agreement and any disputes arising from the use of
these services. The courts of NSW and the Commonwealth of Australia shall have non-exclusive
jurisdiction.
SkillsMarket respects and upholds your rights to privacy protection in Australia under
the Privacy Act 1988 (Cth) and is required to comply with the National Privacy Principles
in respect of the collection, use, disclosure and handling of personal information. This
Privacy Policy details the practices we have adopted to protect your privacy, so that you
can feel confident about how we manage the personal information you entrust to us.
Collection of your personal information
SkillsMarket collects your personal information in the following ways: from you when you
register an iProlfile account and when you provide your information to us through your iProfile;
and from iProfile Compatible Organisations that you have provided your information to when you
have used the services of those organisations.
What do we do with your personal information?
SkillsMarket will use your personal information to create an iProfile account, to create your
iProfile and to provide you with the information, services and products necessary for your
use of iProfile and/or this website.
SkillsMarket may use your personal information to contact you by e-mail, phone, facsimile
or mail from time to time in relation to our services or the services of third parties
connected to iProfile. By agreeing to these terms of use, you are consenting to receive
such information.
SkillsMarket may transfer your personal information to other entities within the SkillsMarket
group of companies and/or their affiliates.
SkillsMarket may engage sub-contractors to assist in managing your personal information.
Skillsmarket may use data obtained from your personal information to produce market information
(eg. National Pay Rate Benchmarking). Data used in this way will be on an anonymous basis. By
agreeing to these terms of use, you are consenting to us using your information in this way.

Your iProfile will be made available to other iProfile Compatible Organisations if you have
used their services, for example, submitting your information to them. iProfile Compatible
Organisations may use your personal information to contact you by e-mail, phone, facsimile
or mail from time to time in relation to their services. By agreeing to these terms of use,
you are consenting to the use and disclosure to such organisations and to receiving such
information. However, the personal information held on your iProfile will only be shared
amongst recruitment companies to which you have already submitted your details or will submit
your details in the future.
Your iProfile will also be made available to third parties who you agree to give access to your iProfile.
You consent to SkillsMarket, persons authorised by SkillsMarket and its sublicensees (including iProfile
Compatible Organisations and overseas data processing organisations) using your personal information in
any way reasonably required by them to provide you with a recruitment service (and all things incidental
to performing this task), including to attribute, alter, amend, aggregate and present information or data
that you provide in any way.
Your personal information will never be shared, sold, rented or otherwise disclosed to third parties (except
as required for any statutory or legal requirements) in ways different from what is described in this Privacy
Policy. We will take all reasonable steps to maintain the security and integrity of your personal information
including the use of computer access passwords, lock-up cabinets, personnel policies and firewalls.

2. TERMS OF USE – ACCESS TO WEBSITE
The following terms and conditions apply to the access and use of this website by iProfile
Compatible Organisations and are binding on such organisations. 'iProfile Compatible
Organisation' means an organisation that SkillsMarket has licensed the use of the
iProfile database and software.
The following terms and conditions also apply to any other persons who access iProfile via
this website and are binding on such third parties.
Your responsibilities
You shall not use this or any other iProfile service to distribute defamatory, obscene or hateful
material, nor shall you attempt to violate the security of the website. You shall ensure that you
have received any appropriate permission when disclosing information confidential to other persons
and you shall respect all duties of confidentiality imposed on you by common law or contract when
using the information which you access via the iProfile system. You shall not disclose the password
by which you access the iProfile service to any third party and you are responsible for any actions
